Terms & Conditions
- 1. All claim for shortage or damage must be made in writing within 7 days of receipt of merchandise.
- 2. Request for returns or exchanges of parts must be made in writing. When the request is approved, a Return Merchandise Authorization Number will be issued and this number must be referenced on the outside of the package. All returned merchandise must be shipped freight prepaid, complete with all packaging material. Goods returned without an RMA Number, and / or not prepaid, will be refused. Products sold “as is” are not returnable at any time.
- 3. Products which are the result of customer error, cannot be returned. Verify your purchase carefully.
- 4. All shipments and prices are quoted FOB Fremont, CA. The risk of loss of all goods shall pass to Buyer upon delivery to a common carrier or when Buyer takes possession of goods at Seller’s place of business.
- 5. There will be a lifetime warranty for memory products, unless otherwise stated. Seller reserves the right to determine the terms for goods returned under warranty, including but not limited to repair, replacement, or the issuance of a credit or refund.
- 6. If any action is initiated for the collection of amount due or to enforce the terms or conditions, it is expressly agreed that the prevailing party should be entitled to attorneys’ fees and costs of suit incurred.
- 7. The invoice shall be governed by and enforced in accordance with the laws of the State of California. The venue for any legal action or proceeding brought to remedy any breach for the obligations under this invoice, or to interpret or enforce the obligations hereunder, shall be in Alameda County, California.
- 8. Products furnished by Seller are sold on the terms and conditions on Seller’s acknowledgement form. The terms constitute the only agreement between the parties with respect to the products sold,, and supersede all prior warranties of Seller.
- 9. Custom and special order modules are non-cancelable and non-returnable.
- 10. Warranty is voided if original labels are missing or if products are physically damaged.
